COPYRIGHT AND COMPLAINT POLICY
Last updated:
As Niafix Ltd. ("Company", "We", "Us"), we attach the highest importance to third parties' intellectual property rights, personal rights, and community safety. The Perabook platform ("Platform") is a "hosting provider" where user-generated content is published.
If you believe that any book or content published on the Platform infringes your rights or violates community rules, you can report it using the "Report" button on the content page or by emailing [email protected].
Incoming reports are classified and processed according to the Violation Types defined in our system architecture:
1. Intellectual Property Violations
- Copyright Violation (CopyrightViolation): If you detect that a literary work, book, poem, or image belonging to you or for which you are the legal representative has been published on Perabook without permission, you should select this option. Providing legal evidence/links showing that the original work belongs to you in your report will expedite the process.
- Trademark Violation (TrademarkViolation): If your registered trademark, trade name, or logo is used by users in books or profile names in a way that misleads readers (for example, by acting as if it were an official account of a corporate brand), a review is initiated under this violation type.
2. Community and Safety Violations
- Harassment / Threat: Book content, chapters, or comments that directly target other users with the intent to intimidate, including blackmail or persistent stalking, are assessed under this category.
- Hate Speech: Content that degrades individuals or communities or incites hostility based on sensitive categories such as race, religion, gender, sexual orientation, ethnic origin, or disability is strictly prohibited.
- Spam: Content is removed where books are used solely for advertising, misleading links to external sites are provided, or repetitive/meaningless content is produced in a way that disrupts the platform's operation.
- Privacy Violation (PrivacyViolation): Non-fictional disclosure content containing another person's name, phone number, home address, private life photos, or personal data without their consent is immediately taken down under this category.
- Other (Other): For situations that do not fall into the above categories but constitute a violation of laws or general moral standards (threatening public safety, promoting illegal substances, etc.), a reasoned explanation is expected through this option.
3. Review and Takedown Procedure
Niafix Ltd. reviews content reported under one of the above notification types according to the following process:
- 1. Preliminary Review: From the moment a report reaches our complaint system, the relevant content is subject to preliminary review by our technical team and legal advisers.
- 2. Temporary Suspension and Removal: For substantiated violation reports that may cause irreversible harm, such as CopyrightViolation, PrivacyViolation, or Harassment, Niafix Ltd. reserves the right, at its sole discretion, to temporarily block access to or remove content from publication until a final decision is made.
- 3. Author's Right of Defence (Counter-Notification): The Author whose content is removed is informed via the platform or by email. If the Author submits a counter-notification proving that the content does not contain a violation (for example, that they have permission to use the copyrighted work or that the content is entirely original), Niafix Ltd. re-evaluates the situation.
- 4. Account Termination Sanction: Accounts of users who repeatedly infringe copyright, spread hate speech, or engage in harassment in the same or different books may be permanently closed by Niafix Ltd. without any further notice.
4. Procedure and Policy Changes
Niafix Ltd. reserves the right to update this Complaint Policy and the violation types defined in the system without prior notice in order to optimise moderation processes on the platform and provide more effective protection against copyright and community violations.
- The current policy takes effect from the moment it is published on the Platform.
- Users and rights holders must take into account the most current policy text in force when filling out notification forms or submitting complaints.
